The Site and the Applications are operated and provided by Ardour Technologies Ltd. registered at the UK companies house under company number 10188737 (“SAVR”, “We”, “Us” and “Our”). For the purposes of the Data Protection Act 1998 and subsequently the General Data Protection Regulation (together referred to as the “Acts”), We are the data controller. SAVR is committed to protecting your privacy on-line and this Policy explains how We collect information, what We do with it and what controls You have.

    2. By using the Site or any of the Applications You consent to the collection and use of information in accordance with this Privacy Policy.

    3. We reserve the right to change this Policy at any time by changing it on the Site or updating the Applications.

  1. DEFINITIONS

    1. The “Application” facilitates transactions between consumers as end customers (“Users” or “You” or “Your”) and professional service providers and/or sellers selling goods and services to Users (each an “Operator”) by providing the Application to Users which allows Users to locate Venues, form a virtual tab with other Users, browse associated Goods, place Orders and enter into a Contract with the Vendor to purchase Goods (the “Application”).

    2. “Contract” means the contract between the Operator and the User for the sale and purchase of Goods;

    3. “Device” means the User’s mobile telephone, smartphone, or handheld device used to access the Application

    4. “Goods” means any products or services listed for sale by an Operator at a Venue via SAVR;

    5. “Operators” as defined in Article 2;

    6.  “Order” means an offer made by the User to purchase Goods from the Operator via SAVR;

    7.  “Payment Gateway Provider” as selected by Ardour Technologies Ltd. is Stripe Inc., a limited liability company Headquartered at address 185 Berry Street, Suite 550, San Francisco CA 94107, United States;

    8.  “Payment Method” means the credit or debit card(s) or alternative forms of payment used through the Payment Gateway Provider in respect of payment of Goods;

    9. “Payment Processor” means a PCI DSS compliant Payment Gateway Provider selected by Ardour Technologies Ltd. to store, process, and transmit a User’s payment information;

    10. “SAVR Retail” or “Retail” or “Retail Application” means the SAVR application required for Operators to manage Users of the Application including but not limited to Your Orders, Your Tabs, and the availability of Goods to Users at the discretion of the Operator;

    11. “Services” means all those services provided by SAVR to Users through but not limited to the Application;

    12. “Tab” means the digital tab within the Application which can be joined by other Users based on submitting a unique numerical code generated by SAVR and through which the Operator communicates to any Users within a Tab the total amount payable and through which Users can place multiple Orders and through which Users can pay a proportion of the Tab’s total amount.

    13. “Tab Manager” means the User in whose name the tab is opened, or in the event that this User is no longer in the tab, the designated User who assumes Tab Manager responsibility for payment methods.

    14.  “Venue” means an establishment operated by any Operator that offers its Goods via the Application

  1. INFORMATION YOU SHARE WITH US

WE REQUIRE CERTAIN INFORMATION TO PROVIDE OUR SERVICES TO YOU. FOR EXAMPLE, YOU MUST HAVE AN ACCOUNT IN ORDER TO USE THE APPLICATION, INCLUDING FINDING VENUES, CHECKING INTO A VENUE OF CHOICE, PLACING ORDERS, MAKING PAYMENTS, CREATING AND JOINING TABS, AND TAKING ADVANTAGE OF PROMOTIONS THROUGH THE APPLICATION. WHEN YOU CHOOSE TO SHARE THE BELOW INFORMATION WITH US, WE COLLECT IT AND USE IT TO OPERATE OUR SERVICES.

 

  1. Basic Account Information

    1. Personal Information such as your name, email address, date of birth, and a portrait photograph are used by the Operator to verify your identity upon delivery of Your Orders placed through the Application. You provide this information upon registration on the Site or Applications, uploads or submissions of any material via the Site or Applications, requests for any information, or reports of problems;

Account information such as Your log-in and password details including if You access the Site or Applications through a social networking profile, we may collect, store and use the details of that social networking profile and any information contained therein in order to populate any forms you might wish to complete on the Site or Application.

      1. Collecting Your real time and submitted location data to provide location services requested by You, in order to display to You when there is a Venue in Your location or Your searched locations that has adopted SAVR and where You can use the Application and the Services;

      2. Collecting Your real time and submitted location data to provide location services requested by You, in order to display to You when there is a Venue in Your location that has adopted SAVR based on your custom search parameters.

      3. The User has the right to not allow SAVR to collect Your real time and searched location data. The User acknowledges and accepts however that choosing not to provide location service requests will mean that the Application will not work properly and in this case We recommend that the User uninstalls the Application.

    2. Check-In’s

      1. Collecting data on which venues you check into within the Application.

    3. Orders and Payments

      1. Collecting data on the Goods ordered by You including the time a Good or set of Goods were ordered, the venue in which they were ordered, the most frequently ordered Good by the User, whether the User’s orders and payments were made within a tab or individually, the value of the Order, and the individual Goods in each Order.

      1. Collecting data on Orders and Payments being placed within a tab or individually to the User.

    5. Cookies and Similar Technologies

      1. Pixel Gifs – Pixel Gifs/web beacons – these are small image files that may be placed by us or third parties in respect of your use of the Site or within the body of our newsletters so we or third parties can understand which parts of the Site are visited or whether particular content is of interest.

      2. Flash cookies – We may use Adobe Flash Player to display video or image content. We do not serve Flash cookies but Adobe Flash Player may be used by third parties serving advertisements to the Site in cases where these advertisements are served with flash related content. It may not be possible to block or restrict flash cookies using your browser settings, however information on how to control Flash Player privacy, and security settings is available from the Adobe website at: http://www.adobe.com/products/flashplayer/security

      3. (rights) Push notification token – On installation of the app a unique token is generated to allow the sending of push notifications to a specific device for the purposes of the app. If you do not confirm the use of push notifications, then no such token is sent. If you deactivate push messages, then this token is no longer sent.

    1. Technical information from your mobile device (such as your IP address, push notification token, Operating System language Setting, the type of device and operating system of the device on which the Application is downloaded) relating to the service you receive;

In the case of referral programmes or similar initiatives run on the Site and/or Applications, SAVR will collect contact information of an individual who is known to You, referred by You, and who may find our products or services to be of interest. We will only use those contact details for the purpose of the relevant initiative (and not for general marketing purposes). By providing us with their details, You confirm that You have their permission to do so and You must not provide Us with the details of anyone from whom You do not have such permission. SAVR reserves the right to identify You as the User who made the referral in the referral promotion that is sent to said individual.

SAVR USES YOUR INFORMATION TO IMPROVE ITS SERVICES WHILST AT THE SAME TIME ENSURING THAT THE OPERATOR HAS THE NECESSARY INFORMATION TO FULFIL THE OBLIGATIONS OF THEIR OPERATING LICENSE.

SAVR SHARES NON-PERSONALLY IDENTIFIABLE INFORMATION AND AGGREGATED INFORMATION IN ORDER TO IMPROVE ITS SERVICES AND PROVIDE YOU WITH RELEVANT PROMOTIONS AND OFFERS AS PART OF THE SERVICES. IN THE LIMITED CIRCUMSTANCES WHERE DISCLOSE YOUR PRIVATE PERSONAL DATA, WE DO SO SUBJECT TO YOUR CONTROL, BECAUSE ITS NECESSARY TO OPERATE OUR SERVICES OR BECAUSE ITS REQUIRED BY LAW.

    1. We share or disclose non-personal data, such as aggregated information like the total number of a certain Good or category of Goods has been ordered, the number of people who have checked into a specific venue or set of venues, and the amount and size of tabs created by Users.

    2. using aggregate statistics about Yours and other visitors’ SAVR activity in order to demonstrate the Service’s capabilities to reputable third parties in order to make the Services better. These statistics will include no personally identifiable information in accordance with the Data Protection Act (1998) and subsequently GDPR (May 25, 2018).

    1. If SAVR believes in its sole and absolute discretion that Your conduct (whether in using the Applications, our Services or otherwise) is unlawful or threatens the welfare of any user of the Application or the Services or any member of SAVR’s staff, SAVR reserves the right to report You to the police or other judicial body and disclose any Personally Identifiable Information in order to comply with a law, regulation, legal process, or government request.

WE WILL ALSO PROVIDE YOU TOOLS TO OBJECT, RESTRICT, OR WITHDRAW CONSENT WHERE APPLICABLE FOR THE USE OF DATA YOU HAVE PROVIDED TO SAVR AND WE MAKE THE DAT YOU SHARED THROUGH OUR SERVICES PORTABLE AND PROVIDE EASY WAYS FOR YOU TO CONTACT US.

 

  1. Accessing or rectifying Your Personal Data

    1. If you have an account registered with SAVR we provide you the tools to modify the Personal Data you have provided us and you can request access to, correction and deletion of Your Data.

    2. You have a legal right under the Data Protection Act (1998) and subsequently the GDPR (2018) to a copy of all Personal Information about You held by Us. On request, SAVR will provide You with a copy of this information subject to a fee not exceeding the prescribed fee permitted by law.

  2. Deletion

    1. We keep your Logged Information for a maximum of 18 months. If you wish to delete your account, a request must be made to hello@savrapp.co.uk and your information will be terminated 30 days from the date of request and no longer searchable on our systems.

    2. You acknowledge however that SAVR will still retain copies of Your aggregated non-personally identifiable information that may or may not be made available to Third Parties for the purpose of improving the Services.

  3. Consent

    1. SAVR lets you decide:

      1. If you want to receive information regarding the products and services of SAVR and/or those of third parties.

      2. If you want to share your details with third parties in order to receive information regarding their products and services, either at the point such information is collected on the Site or Application (by checking or un-checking, as directed, the relevant box) or, where you do not wish us to continue to use your information in this way, by following the unsubscribe instructions on any communications sent to you.

    1. If a User wishes to access the information they have shared with Us they will be required to submit a request to Us at the details stipulated in Article 11.  

  1. SECURITY AND LIMITATION OF LIABILITY

    1. SAVR is strongly committed to securing all personally identifiable information associated with Our Users and visitors and whilst we cannot ensure or guarantee that loss, misuse or alteration of information will never occur, we use all reasonable efforts to prevent it.

    2. Users acknowledge that submission of information over the internet is never entirely secure. We will use all reasonable efforts to prevent the security of information the User has submitted via the Website and Applications whilst it is in transit over the internet, but we cannot guarantee it and any such submission is performed at Your own risk.

    3. SAVR is not responsible for loss, misuse or alteration of Your information as a result of unauthorised access to any of Your devices.

    4. The Website and Applications may, from time to time, contain links to external sites; the content and privacy policies of which are outside of SAVR’s control and responsibility.

    5. Any information that is disclosed in the areas described in Article 4.3.6 will become public information and SAVR is not responsible for loss, misuse or alteration of Your personal information that you disclose and you do so at your own risk.

  1. PAYMENT GATEWAY PROVIDER

    1. SAVR uses a Payment Gateway Provider to collect payments from Users on behalf of the Operator, which the User acknowledges accepts, and subsequently consents to the Stripe’s Checkout User Terms of Service (https://stripe.com/gb/checkout/legal)

    2. SAVR’s role is limited to providing the Application and is not responsible for collecting payment details, and no acting SAVR personnel will ever ask You for Your payment details. The User will be providing their payment information directly to Stripe which operates a secure, PCI DSS Level 1 compliant server to process payment details, encrypting your payment information and authorising payments. If You receive any correspondence on behalf of SAVR requesting such details, do not provide them. In this case, SAVR accepts no liability for the incorrect disclosure of payment details to unauthorised individuals.

    3. SAVR will always use a PCI DSS Level 1 compliant (https://stripe.com/docs/security/stripe) payment provider to store, process and transmit Users’ Payment Method data, to ensure the required level of payment security. SAVR reserves the right to change its Payment Gateway Provider at its sole and absolute discretion, provided that any such Payment Gateway Provider meets the security compliance as stated above.

  1. DATA STORAGE AND INTERNATIONAL TRANSFERS

    1. Information that you submit via the Site or Application may be transferred to countries outside the European Economic Area (“EEA”). By way of example, this may happen if one or more of our servers are from time to time located in a country outside the EEA or one of our service providers is located in a country outside the EEA. If you make contact with any business featured on the Site your details may be transferred outside the EEA. If we transfer your information outside the EEA in this way, we will take steps to ensure that your privacy rights continue to be protected. By submitting information via the Site or Application, you agree to this storing, processing and/or transfer.

    2. In addition, if you use our services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those services.
